PENYIDIKAN TERHADAP ANAK SEBAGAI PELAKU TINDAK PIDANA PENCURIAN (Studi di Kepolisian Resor Cilacap) Oleh: Muhammad Iqbal E1A016103 ABSTRAK Tindak pidana pencurian yang dilakukan oleh anak masih menjadi permasalahan yang sering ditemui saat ini. Ketentuan Undang-undang Nomor 11 Tahun 2012 tentang sistem peradilan pidana anak secara khusus telah mengatur proses peradilan terhadap anak yang berkonflik dengan hukum pada tingkat penyidikan, penuntutan, dan proses pemeriksaan di pengadilan negeri. Penyidikan sebagai serangkaian tindakan penyidik dalam hal menurut cara yang diatur dalam undang-undang untuk mencari serta mengumpulkan bukti guna menemukan tersangkanya merupakan tahap pertama dalam sistem peradilan pidana. Dalam proses penyidikan juga tidak terlepas dari perlindungan dan apa saja yang menjadi hak anak sesuai dengan Unang-undang Nomor 35 Tahun 2014 tentang perubahan atas Undang-undang Nomor 23 Tahun 2002 tentang perlindungan anak. Penelitian ini menggunakan metode penelitian kualitatif dengan pendekatan yuridis empiris dan spesifikasi penelitian deskriptif analitis. Adapun penelitian ini dilakukan di Unit Pelayanan Perempuan dan Anak, Kantor Direktorat Reserse Kriminal Umum Kepolisian Resor Cilacap (Polres Cilacap). Jenis data yang digunakan meliputi data primer dan data sekunder. Metode pengumpulan data primer diperoleh melalui wawancara dengan informan sementara itu data sekunder diperoleh melalui studi kepustakaan. Berdasarkan analisis dari hasil penelitian menunjukan bahwa proses penyidikan terhadap anak sebagai pelaku tindak pidana pencurian di Polres Cilacap dilakukan sesuai dengan ketentuan Undang-undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak, Kitab Undang-undang Hukum Acara Pidana, dan Peraturan Kapolri Nomor 6 Tahun 2019 tentang penyidikan. Adapun hambatan yang mempengaruhi penyidik dalam melakukan proses penyidikan terhadap anak sebagai pelaku tindak pidana pencurian timvul dari faktor hukum, faktor aparat penegak hukum, faktor sarana prasarana, faktor masyarakat, dan faktor kebudayaan. INVESTIGATION OF CHILDREN AS PERPETRATORS OF CRIMINAL ACTS OF THEFT (Study at the Cilacap Resort Police) by: Muhammad Iqbal E1A016103 ABSTRACT The crime of theft committed by children is still a problem that is often encountered today. The provisions of Law Number 11 of 2012 concerning the juvenile criminal justice system specifically regulate the judicial process against children in conflict with the law at the level of investigation, prosecution, and examination process in district courts. Investigation as a series of actions of investigators in cases according to the method regulated by law to seek and collect evidence to find suspects is the first stage in the criminal justice system. In the investigation process, it is also inseparable from protection and the rights of children under Law Number 35 of 2014 concerning amendments to Law Number 23 of 2002 concerning child protection. This study used qualitative research methods with an empirical juridical approach and descriptive-analytical research specifications. This research has conducted at the Women and Children Service Unit, Office of the Directorate General of Criminal Investigation of the Cilacap Resort Police (Polres Cilacap). The data used the types of primary data and secondary data. The primary data collection method was obtained through interviews with the informants while the secondary data was obtained through library research.The analysis result of this study showed that the process of investigating children as perpetrators of the crime of theft at the Cilacap Police conducted by the provisions of Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, the Criminal Procedure Code, and the National Police Chief Regulation Number 6 of 2012 2019 regarding the investigation. The obstacles that affect investigators in conducting the investigation process against children as perpetrators of criminal acts of theft came from the legal factors, law enforcement officials, infrastructure factors, community factors, and cultural factors.
