ABSTRAK

Skripsi ini membahas tentang Implementasi Pengawasan dan pengamatan oleh Hakim Pengawas dan Pengamat di Lembaga Pembinaan Khusus Anak Kelas I Kutoarjo. Pelaksanaan putusan pengadilan perlu diawasi dan diamati sehingga lahirnya lembaga Hakim Pengawas dan Pengamat dalam Undang-undang Nomor 8 Tahun 1981 tentang Kitab Undang-Undang Hukum Acara Pidana. Dimana kedudukan seorang hakim tidak hanya bertanggung jawab terhadap penjatuhan hukuman semata melainkan juga harus ikut bertanggung jawab hingga hukuman selesai dijalani si terpidana di lembaga pemasyarakatan melalui pola dan program pembinaan yang diberikan. Di samping tugas penjatuhan hukuman di dalam Pasal 277 KUHAP sampai dengan Pasal 283 KUHAP dibebankan tugas lain yaitu sebagai pengawas dan pengamat keputusan pengadilan. Rumusan masalah dari penelitian ini yang pertama  yaitu mengenai bagaimana implementasi pengawasan dan pengamatan pembinaan oleh Hakim Pengawas dan Pengamat dalam pembinaan warga binaan di Lembaga Pembinaan Khusus Anak Kelas I Kutoarjo dan yang kedua yaitu hambatan apakah yang dihadapi oleh Hakim Pengawas dan Pengamat dalam melakukan pengawasan dan pengamatan di Lembaga Pembinaan Khusus Anak Kelas I Kutoarjo. Dari hasil penelitian yang dilakukan menunjukkan bahwa implementasi tugas Hakim Pengawas dan Pengamat dalam pelaksanaan putusan pengadilan di Lembaga Pembinaan Khusus Anak Kelas I Kutoarjo belum berjalan maksimal. Dalam pelaksanaan tugas Hakim Pengawas dan Pengamat di Lembaga Pembinaan Khusus Anak Kelas I Kutoarjo masih dijumpai adanya hambatan-hambatan, yaitu faktor hukumnya sendiri, faktor penegak hukum, dan faktor sarana atau fasilitas.

ABSTRACT

This thesis discusses about The Implementation Of Supervision and Observation by Supervisory Judges And Observers At The Kutoarjo Class I Children's Special Guidance Institute. The implementation of court decisions needs to be monitored and observed so that the institution of Supervisory Judges and Observers is born in Law Number 8 of 1981 concerning the Criminal Procedure Code. The rule of a judge is not only responsible  for inflicting punishment but also must be responsible until the prisoner is finished serving the convict in the correctional institution through the pattern and program of guidance provided. In addition to the task of imposing convict in Article 277 of the Criminal Procedure Code to Article 283 of the Criminal Procedure Code, other duties are charged, namely as supervisors and observers of court decisions. The formulation of the problem from this research, the first is about how the implementation of supervision and observation of guidance by Supervisory Judges and Observers in fostering inmates in the Special Guidance Institute for Children Class I Kutoarjo and the second is what obstacles are faced by Supervisory Judges and Observers in carrying out supervision and observation. at the Kutoarjo Class I Children's Special Guidance Institute. The results of the research shows that the implementation of the duties of the Supervisory Judge and Observer in the implementation of court decisions at the Kutoarjo Class I Children's Special Guidance Institute has not run optimally. In carrying out the duties of Supervisory Judges and Observers at the Kutoarjo Class I Children's Special Guidance Institute, there are still obstacles, namely the legal factor itself, law enforcement factors, and facilities.
