Diversi merupakan pengalihan penyelesaian perkara anak dari proses peradilan pidana ke proses di luar peradilan pidana. Pengalihan proses peradilan anak atau yang disebut diversi dapat menghindari efek negatif dari proses-proses peradilan. Dengan implementasi ide diversi sangat diperlukan dalam proses peradilan anak, karena dalam praktiknya diversi masih kurang efektif atau jarang digunakan.
Penelitian ini bertujuan untuk mengetahui pelaksanaan diversi terhadap perkara tindak pidana penadahan yang dilakukan oleh anak dan mengetahui faktor pendukung serta faktor penghambat dalam pelaksanaan diversi terhadap perkara tindak pidana penadahan yang dilakukan oleh anak, penelitian ini menggunakan metode yuridis sosiologis dengan spesifikasi penelitian deskriptif. Jenis dan sumber data yang digunakan adalah data primer dan data sekunder.
Berdasarkan hasil penelitian diketahui bahwa penerapan diversi dalam tahap penyidikan terhadap anak yang melakukan penadahan di wilayah hukum Kepolisian Sektor Purwokerto Utara melibatkan beberapa pihak. Proses diversi kasus tindak pidana penadahan yang dilakukan oleh anak dilakukan dengan musyawarah, dan hasil putusan diversi yaitu mengembalikan ke pihak orang tua untuk dilaksanakan pengawasan, pembinaan, dan pembimbingan terhadap pelaku. Faktor pendukung serta penghambat dalam pelaksanaan diversi terhadap perkara tindak pidana penadahan yang dilakukan oleh anak di wilayah hukum Kepolisian Sektor Purwokerto Utara yaitu faktor hukum,sulitnya anak dimintai keterangan oleh Penyidik kendala dimana adanya batas waktu penyidikan yang ditentukan dalam Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak. Faktor penegak hukum yaitu belum adanya persamaan satu persepsi antara penegak hukum yaitu Polisi, Jaksa, Pengadilan (Hakim) dalam suatu penerapan pasal dan kurangnya jumlah penyidik. Faktor masyarakat, pemahaman masyarakat mengenai suatu Undang-Undang yang masih kurang
khususnya orang tua pelaku dalam menyelesaikan proses diversi. Kata kunci: Diversi, Anak, Penadahan

Diversion is the transfer of the settlement of children's cases from the criminal justice process to a process outside of criminal justice. Diversion of juvenile justice processes or so-called diversion can avoid the negative effects of judicial processes. With the implementation of the idea of diversion, it is very necessary in the juvenile justice process, because in practice diversion is still less effective or rarely used.
This study aims to determine the implementation of diversion against cases of criminal acts of detention committed by children and to determine the supporting factors and inhibiting factors in the implementation of diversion to cases of criminal acts of detention committed by children, this study uses a sociological juridical method with descriptive research specifications. The types and sources of data used are primary data and secondary data.
Based on the results of the study, it is known that the application of diversion in the investigation stage of children who are detained in the jurisdiction of the North Purwokerto Sector Police involves several parties. The process of diversion of cases of criminal acts of detention committed by children is carried out by deliberation, and the result of the diversion decision is to return it to the parents for supervision, guidance, and mentoring of the perpetrators.
Supporting and inhibiting factors in the implementation of diversion to cases of criminal acts of detention committed by children in the jurisdiction of the North Purwokerto Sector Police, namely legal factors, the difficulty of children being questioned by investigators, obstacles where there is a time limit for investigations specified in Law Number 11 of 2012 concerning Juvenile Criminal Justice System. Law enforcement factors are the absence of a common perception between law enforcers, namely the Police, Prosecutors, Courts (Judges) in an article application and the lack of investigators. Community factors, public understanding of a law that is still lacking, especially the parents of the perpetrators in completing the diversion process.
