PERTANGGUNGJAWABAN PEMERINTAH DALAM PENCEMARAN SUNGAI YANG MENYEBABKAN IKAN MATI MASSAL DI SURABAYA
(Tinjauan Yuridis terhadap Putusan Pengadilan Negeri Surabaya  Nomor: 08/ Pdt.G/2019/PN.Sby)

Abstrak

Tujuan penelitian ini adalah untuk menganalisis pertimbangan hukum hakim dalam mengkulaifisir unsur-unsur perbuatan melawan hukum dalam putusan Nomor 08/ Pdt.G/ 2019/ PN.Sby serta pertimbangan hukum hakim dalam mengabulkan tuntutan Penggugat dalam Putusan Nomor 08/Pdt.G/2019/PN.Sby.
Metode Penelitian yang digunakan adalah yuridis normatif dengan metode pendekatan perundang-undangan dan konsep dengan spesifikasi deskriptif, dengan sumber data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier, data ini disajikan dalam bentuk teks naratif yang disusun secara sistematis. Analisis data dilakukan dengan metode kualitatif. 
Hasil penelitian ini menghasilkan kesimpulan, perbuatan pemerintah yang melakukan pembiaran terhadap pelaku usaha yang membuang limbah melebihi baku mutu telah memenuhi unsur perbuatan melawan hukum yaitu melanggar hak subyektif, serta bertentangan dengan kewajiban hukum si pelaku. Majelis hakim dalam pertimbangan hukumnya mengabulkan sebagian tuntutan dari penggugat diantaranya berupa pengembalian keadaan pada keadaan semula.

GOVERNMENT RESPONSIBILITY FOR RIVER POLLAMINATION THAT CAUSES MASS DEAD FISH IN SURABAYA (Juridical Review of the Surabaya District Court Decision Number: 08 / Pdt.G / 2019 / PN.Sby) 
Abstract
Purpose of this study is to analyze judges' legal considerations in calculating the elements of action. against the law in decision Number 08 / Pdt.G / 2019 / PN.Sby as well as the judges' legal considerations in granting the Plaintiff's demands in Decision Number 08 / Pdt.G / 2019 / PN.Sby. 
The research method used is juridical normative with statutory approaches and concepts with descriptive specifications, with secondary data sources consisting of primary legal materials, secondary legal materials, and tertiary legal materials, this data is presented in the form of narrative text which is systematically compiled. . Data analysis was performed using qualitative methods. 
The results of this study resulted in the conclusion that the government's actions that allow business actors to dispose of waste beyond the quality standard have met the elements of an illegal act, namely violating subjective rights, and contradicting the legal obligations of the perpetrator. The panel of judges in their legal considerations granted part of the plaintiff's demands, including restoring the situation to its original state.
