PENYELESAIAN KASUS PENCEMARAN LAUT AKIBAT TUMPAHAN MINYAK JENIS MADURA CRUDE OIL MENURUT HUKUM INTERNASIONAL (Studi tentang Kasus Tabrakan Kapal Alyarmouk dengan Kapal MV Sinar Kapuas di Perbatasan Laut Teritorial Indonesia dan Singapura)

United Nations Convention on The Law of the Sea 1982 (UNCLOS 1982) adalah perjanjian internasional yang dihasilkan dari Konferensi Perserikatan Bangsa-Bangsa tentang hukum laut. Tahun 2015, pencemaran di laut akibat tumpahan minyak jenis Madura Crude Oil yang disebabkan tabrakan kapal Alyarmouk dan kapal MV Sinar Kapuas sangat merugikan Indonesia. Tumpahan minyak tersebut menyebabkan ekosistem laut Indonesia tercemar. Penelitian ini bertujuan untuk mencari cara untuk menyelesaikan kasus pencemaran laut karena tumpahan minyak yang mencemari laut Indonesia akibat tabrakan kapal asing. Metode pendekatan penelitian yaitu dengan yuridis normatif. Spesifikasi penelitian dalam penelitian ini adalah penelitian deskriptif analitis. Jenis dan sumber data yang dipergunakan adalah data sekunder yang digunakan meneliti suatu kasus. Berdasarkan permasalahan di atas, penyelesaian kasus pencemaran laut memiliki berbagai macam dasar hokum antara lain Konvensi Brussels 1910, International Convention on Civil Liability for Oil Pollution Damage 1969 (CLC 1969), Fund Convention The International Oil Pollution Compensation Funds 1978 (IOPCFunds 1978), Konvensi Maritime Pollution 1978 (MARPOL), UNCLOS 1982 dan International Convention on Civil Liability for Bunker Oil Pollution Damage 2001 (Bunker Convention 2001). Pasal 194 ayat 2 UNCLOS 1982 menyebutkan harus adanya tindakan untuk mencegah, mengurangi dan mengendalikan pencemaran laut serta Pasal 235 ayat 1 UNCLOS 1982 tentang tanggung jawab dan kewajiban ganti rugi atas pencemaran yang terjadi karena pihak asing. Pemerintah Indonesia berkewajiban untuk mengambil tindakan yang tegas untuk menjamin wilayah territorial Indonesia tetap terlindungi dari pencemaran laut. The United Nations Convention on the Law of the Sea 1982 (UNCLOS 1982) is an international agreement that was produced from the United Nations Conference on the law of the sea. In 2015, Pollution in the sea due to the spill of Madura Crude Oil which caused the collision of Alyarmouk ship and MV Sinar Kapuas ship was very detrimental to Indonesia. The Oil spill made Indonesian marine ecosystem to be polluted. This research aims to found ways to resolved cases of sea pollution due to oil spills that pollute the Indonesian sea due to foreign ship collisions. Research methods that used is normative juridical. The research specifications in this study is analytical descriptive research. The type and source of data is secondary data used to research the case. Based on the problems, there are many kind legal rules to resolved oil spill case includes Brussels Convention 1910, International Convention on Civil Liability for Oil Pollution Damage 1969 (CLC 1969), Convention on International Oil Pollution Compensation Fund 1978 (IOPCFunds 1978), Convention Maritime Pollution 1978 (MARPOL), UNCLOS 1982 and the International Convention on Civil Liability for 2001 Bunker Oil Pollution Damage (2001 Bunker Convention). Article 194 paragraph 2 of UNCLOS 1982 states must had action to prevent, reduce and control sea pollution as well and Article 235 paragraph 1 of UNCLOS 1982 about liability and gave compensation for pollution from foreign parties. The Indonesian government must took action to ensure that Indonesia's territorial territories protected from marine pollution. Keywords: arrangement and settlement, marine pollution, ship collision.
