ABSTRAK

Pasal 1 Undang-Undang Nomor 1 Tahun 1974 disebutkan bahwa perkawinan ialah ikatan lahir batin antara seorang pria dengan seorang wanita sebagai suami isteri dengan tujuan membentuk keluarga (rumah tangga) yang bahagia dan kekal berdasarkan Ketuhanan Yang Maha Esa, namun dalam praktik banyak terjadi permasalahan kehidupan rumah tangga yang berakibat perceraian, sehingga tujuan dari perkawinan tersebut tidak tercapai, seperti halnya salah satu perkara mengenai gugat cerai karena suami bau badan yang menyebabkan terjadinya perselisihan, yang terjadi dipengadilan Agama Pasuruan dengan nomor perkara : 0590/Pdt.G/2014/PA.Pas.
Permasalahan dalam penelitian ini adalah bagaimana pertimbangan Hukum Hakim dalam memutus perkara pada putusan Pengadilan Agama Pasuruan Nomor: 0590/Pdt.G/2014/PA.Pas. Metode penelitian yang digunakan dalam penelitian ini adalah pendekatan yuridis normatif, spesifikasi penelitian preskriptif analitis, metode pengumpulan data studi kepustakaan, metode analisis data normatif kualitatif.
Hasil penelitian ini menunjukan bahwa pertimbangan hakim dalam memutuskan perkara tersebut sudah tepat berdasarkan pada Pasal 39 ayat(2) Undang-Undang Nomor 1 Tahun 1974 tentang perkawinan jo Pasal 19 huruf (f) Peraturan Pemerintah Nomor 9 Tahun 1975 jo Pasal 116 huruf (f) Kompilasi Hukum Islam, sebaiknya hakim tidak mengenyampingkan Pasal 19 huruf (e) Peraturan Pemerintah Nomor 9 Tahun 1975 jo Pasal 116 huruf (e) Kompilasi Hukum Islam.

ABSTRACT

Article 1 of Act Number 1 of 1974 states that marriage is an inner birth bond between a man and a woman as husband and wife with the aim of forming a happy and eternal family (household) based on God Almighty, but in practice there are many life problems households that result in divorce, so that the purpose of the marriage is not achieved, as is the case with a divorce case because of the husband's body odor that occurred in the Pasuruan Religious Court with the number of cases: 0590 / Pdt.G / 2014 / PA. Pas
The problem in this study is how the Judge's Legal considerations in deciding cases in the decision of the Pasuruan Religious Court Number: 0590 / Pdt.G / 2014 / PA.Pas. The research method used in this study is a normative juridical approach, prescriptive analytical research specifications, literature study data collection methods, qualitative normative data analysis methods.
The results of this study indicate that the judge's decision in deciding the case is appropriate based on Article 39 paragraph (2) of Law Number 1 of 1974 concerning marriage in conjunction with Article 19 letter (f) of Government Regulation Number 9 of 1975 jo Article 116 letter (f) of the Law Compilation Islam, the judge must not exclude Article 19 letter (e) Government Regulation Number 9 of 1975 jo Article 116 letter (e) Compilation of Islamic Law.
