TINDAK PIDANA PENCURIAN DENGAN PEMBERATAN (Tinjauan Yuridis Terhadap Putusan Pengadilan Negeri Purwokerto Nomor 98/PidB/2016/PN.Pwt)

Kejahatan merupakan fenomena umum yang terjadi di masyarakat. Kejahatan dapat terjadi baik adanya unsur niat maupun keadaan yang mendukung. Tujuan dari penelitian adalah untuk mengetahui pertimbangan hakim dalam memutus perkara Nomor 98/Pid.B/2016/PN.Pwt tentang tindak pidana pencurian dengan pemberatan. Metode penelitian yang digunakan adalah yuridis normatif. Jenis dan sumber data yang digunakan data sekunder dan data primer. Data diolah, disajikan, dianalisis dan tersusun secara sistematis, logis, dan rasional. Berdasarkan hasil penelitian dapat disimpulkan bahwa dalam putusan Nomor 98/Pid.B/2016/PN.Pwt telah memenuhi unsur-unsur tindak pidana pencurian dengan pemberatan dan pelaku dalam kondisi sebagai residivis. Pertimbangan hakim dalam penjatuhan pidana memberikan gambaran bahwa suatu kejahatan harus disikapi menurut tujuan hukum pidana bagi tegaknya keadilan.

Crime is a common phenomenon that happens in society. It will happen when there's a willing to do the crimes or even when it supported by the condition. This research is aimed to observe the judge's consideration in order to make a verdict number 98/Pid.B/2016/PN.Pwt about the criminal act with thievery and oppression. This research uses normative yuridiction method with secondary and primary data as the source of this research. The data will be proceed, presentated, analyzed, and calculated systematically, logically, and rationally. Based on the result of this research, we can conclude that the District Court Verdict Number 98/Pid.B/2016/PN.Pwt has fulfilled the condition of the criminal act with thievery and oppression with the suspect as recidivist. The Judge's consideration in order to make the verdict shows us that every crimes that happened should be proceed as the purpose of the law in order to bring the justice.
