TINJAUAN YURIDIS TERHADAP PEMBERIAN SURAT KUASA MEMBEBANKAN HAK TANGGUNGAN KEPADA PT. BANK SYARIAH MANDIRI CABANG PURWOKERTO

Surat Kuasa Membebankan Hak Tanggungan (SKMHT) memiliki jangka waktu tertentu. SKMHT merupakan surat kuasa yang diberikan kepada Bank Syariah Mandiri dan ditandatangani oleh para pihak, maka bank berkedudukan sebagai pihak pemberi jaminan juga sekaligus sebagai pihak penerima jaminan untuk tanah yang belum bersertifikat pada Bank Syariah Mandiri juga menerima jaminan tanah yang belum bersertifikat tersebut, maka peneliti tertarik mengambil judul TinjauanYuridis Terhadap Pemberian SKMHT Kepada PT. Bank Syariah Mandiri Purwokerto. Metode pendekatan yang dipakai adalah yuridis normatif yaitu suatu penelitian yang menekankan pada ilmu hukum, di samping itu juga berusaha menelaah kaidah-kaidah hukum yang berlaku di masyarakat. Spesifikasi Penelitian yang digunakan adalah deskriptif analitis yaitu penelitian yang menggambarkan keadaan objek yang akan diteliti untuk kemudian dianalisis berdasarkan teori-teori hukum dan praktik pelaksanaan hukum positif yang menyangkut permasalahan tanpa maksud untuk mengambil kesimpulan-kesimpulan yang berlaku umum. Berdasarkan hasil penelitian dan pembahasan dapat disimpulkan bahwa dalam penjelasan umum UUHT angka 7 menegaskan bahwa pemberian SKMHT harus diikuti dengan dibuatnya APHT oleh PPAT dan kemudian didaftarkan ke Badan Pertanahan Nasional. SKMHT pada PT. Bank Syariah Mandiri Purwokerto telah memenuhi syarat subjektif dan objektif namun PT. Bank Syariah Mandiri Purwokerto tidak menerapkan pasal 15 ayat (4) UUHT, sehingga penerapan SKMHT di PT. Bank Syariah Mandiri Purwokerto belum sesuai dengan penjelasan umum UUHT angka 7 dan pasal 15 ayat (4) UUHT. Akibat hukum dari SKMHT di PT. Bank Syariah Mandiri Purwokerto adalah akta tersebut menjadi gugur atau batal demi hukum dimana hal ini diatur dalam Pasal 15 ayat (6) UUHT, sehingga PT. Bank Syariah Mandiri Cab. Purwokerto tidak memiliki kedudukan sebagai kreditur preferen atas SKMHT tersebut.

Bank Syariah Mandiri Branch Purwokerto" The approach method used is normative juridical that is a study that emphasizes the science of law, in addition it also seeks to examine the rules of law applicable in society. Specification The research used is descriptive analytical research that describes the state of the object to be studied for later analyzed based on legal theories and practice of the implementation of positive law concerning the problem without the intention to take conclusions generally accepted. Based on the results of research and discussion it can be concluded that in the general explanation of the Insurance Rights Act number 7 confirms that the provision of Power of Attorney to Burden the Guaranteed Rights must be followed by the making of the Deed of Assignment Rights by PPAT and then registered to the Badan Pertanahan Nasional. Power of Attorney Charging Deposit Rights at PT. Bank Syariah Mandiri Purwokerto has fulfilled subjective and objective requirements but PT. Bank Syariah Mandiri Purwokerto does not apply Article 15 paragraph (4) of the Mortgage Act, so that the application of the Power of Charging Guarantee in PT. Bank Syariah Mandiri Purwokerto is not in accordance with the general explanation of the Insurance Rights Act number 7 and Article 15 paragraph (4) of the Insurance Rights Act. The legal consequences of the Power of Attorney Charges Deposit Rights at PT. Bank Syariah Mandiri Branch of Purwokerto which is not followed by the issuance of the Deed of Assignment Rights and is not registered to the National Land Agency is the deed becomes void or void by law where it is regulated in Article 15 paragraph (6) of the Insurance Rights Act, so that PT. Bank Syariah Mandiri Branch of Purwokerto does not have the position as the preferred creditor of the Power of Attorney Charging the Guarantee Right.
