Abstrak (Bhs. Indonesia)

Pelaksanaan putusan pengadilan perlu diawasi dan diamati sehingga lahirnya lembaga Hakim Pengawas dan Pengamat dalam Undang-undang Nomor 8 Tahun 1981. Kedudukan seorang hakim tidak hanya bertanggung jawab terhadap penjatuhan hukuman semata melainkan juga harus ikut bertanggung jawab hingga hukuman selesai dijalani si terpidana di lembaga pemasyarakatan melalui pola dan program pembinaan yang diberikan. Di samping itu di dalam Pasal 277 KUHAP sampai dengan Pasal 283 KUHAP dibebankan tugas lain yaitu sebagai pengawas dan pengamat keputusan pengadilan.
Hasil penelitian menunjukkan bahwa pelaksanaan pengawasan dan pengamatan berdasarkan Pasal 277-283 Undang-Undang Nomor 8 Tahun 1981 tentang Kitab Undang-Undang Hukum Acara Pidana (KUHAP) dan Surat Edaran Mahkamah Agung Nomor 7 Tahun 1985 tentang Petunjuk Pelaksanaan Tugas Hakim Pengawas dan Pengamat, serta dengan tidak diaturnya ketentuan Hakim Pengawas dan Pengamat dalam ketentuan Undang-Undang Nomor 12 Tahun 1995 tentang Pemasyarakatan, membuat Hakim Pengawas dan Pengamat kurang maksimal dalam pelaksanaan tugas dan fungsinya.

The implementation of the court's decision should be supervised and observed to be the establishment of the Supervisory and Observer Judge institution in Law Number 8 of 1981. No judge responsible for slaughter as well as payable must also take responsibility for the duration of the convicted person in the penitentiary through the Pattern and a given coaching program. In addition, Article 277 of KUHAP up to Article 283 of the Criminal Procedure Code is charged as the supervisor and observer of the court decision.
The results of the study indicate the implementation of the actions and actions based on Article 277-283 of Law Number 8 Year 1981 regarding the Criminal Procedure Code (KUHAP) and Supreme Court Circular Number 7 of 1985 on the Guidelines for the Implementation of the Duties of Supervisor and Observer Judges, as well The non-stipulation of the stipulations of the Supervisory and Observer Judges in the provisions of Law Number 12 Year 1995 concerning, making Supervisory and Observer Judges less than the maximum in the implementation of duties and functions.
