PENYELESAIAN JAMINAN PENYERAHAN SERTIFIKAT HAK MILIK ATAS TANAH OLEH PIHAK KETIGA SEBAGAI JAMINAN HUTANG.

Penelitian ini bertujuan menganalisis putusan Pengadilan Negeri Bantul mengenai penjaminan Sertifikat Hak Atas Tanah sebagai jaminan hutang. Metode penelitian : Yuridis Normatif, spesifikasi : Deskriptif dan analisis : normatif kualitatif. Berdasarkan hasil analisis diperoleh kesimpulan bahwa : 1) Penyerahan Serttifikat Hak Atas Tanah sebagai jaminan, tidak menimbulkan akibat hukum lahirnya Hak Jaminan Kebendaan atau Hak Tanggungan, karena obyeknya bukan Hak Atas Tanah, tidak dilakukan melalu prosedur pembebanan Hak Tanggungan yang terdiri dari tiga fase, yaitu : “Janji memberikan jaminan Hak Tanggungan”, adanya “Pembebanan Hak Tanggungan dengan akta PPAT”, dan dilakukannya “Pendaftaran Hak Tanggungan di Kantor Pertanahan” dan 2) Akibat hukum dari adanya penyerahan sertifikat sebagai jaminan melahirkan hak retensi, yaitu hak menahan (tetap memegang) Sertifikat Hak Atas Tanah sampai semua tagihan kreditur dibayar oleh debitur.

This study aims to analyze the Bantul District Court's decision on Land Rights Certificate guarantees as collateral . Methods: normative juridical , specifications : Descriptive and analysis : qualitative normative . Based on the analysis we concluded that : 1 ) Submission Serttifikat Land Rights as collateral , does not give rise to legal consequences birth of Rights guarantee material or Encumbrance , because the object is not Landrights , was not done through the procedure of loading Encumbrance which consists of three phases , namely " Promise guarantees Mortgage " , the " Encumbrances Encumbrance by deed PPAT " and does " Registration of Encumbrance Land Office " and 2 ) the legal consequences of the transfer of the certificate as collateral created rights of retention , namely the right to hold ( keep holding ) Certificate of Land Rights until all bills are paid by the debtor's creditors .
