Abstrak (Bhs. Indonesia)

Seorang perawat mempunyai risiko yang besar dalam memberikan pelayanan keperawatan, maka diperlukan perlindungan bagi perawat. Menurut Peraturan Menteri Kesehatan Republik Indonesia Nomor HK.02.02/MENKES/148/I/2010 tentang Izin dan Penyelenggaraan Praktik Perawat, salah satu hak perawat adalah memperoleh jaminan perlindungan terhadap risiko kerja yang berkaitan dengan tugasnya. Risiko kerja perawat menurut Muhammd Khoirul terdiri atas risiko tertular penyakit dan kecelakaan kerja, risiko bekerja 24 jam, risiko stress karena tekanan dari pekerjaan, risiko kelebihan tugas yang tidak disertai upah lembur, risiko mendapat jasa medis kecil, risiko adanya pengaduan dari pasien, risiko tidak bisa hidup normal karena pekerjaan tidak teratur. Penulis merumuskan masalah: Bagaimana jaminan perlindungan hukum terhadap risiko kerja perawat dalam pelayanan keperawatan di Puskesmas Kahuripan Tasikmalaya?Faktor-faktor apa saja yang cenderung mempengaruhi terhadap pelaksanaan jaminan perlindungan hukum perawat? Berdasarkan pendapat Muhammad Khoirul dan Peraturan Menteri Kesehatan di atas maka jaminan perlindungan hukum terhadap risiko kerja perawat, dapat dibatasi dengan parameter sebagai berikut:
1.	Perlindungan terhadap tertular penyakit dan kecelakaan kerja.
2.	Perlindungan keamanan kerja selama 24 jam.
3.	Perlindungan terhadap kondisi psikis perawat dan tekanan pekerjaan.
4.	Perlindungan jaminan upah lembur dari kelebihan tugas dan pekerjaan.
5.	Perlindungan tunjangan kesehatan berupa jasa medis.
6.	Perlindungan terhadap tuntutan pengaduan dari pasien.
7.	Perlindungan atas kehidupan yang normal
Dapat ditarik satu kesimpulan bahwa secara umum jaminan perlindungan hukum terhadap risiko kerja perawat dalam pelayanan keperawatan relatif memadai. Sedangkan untuk faktor-faktor yang mempengaruhi pelaksanaan jaminan perlindungan hukum cenderung mendukung dan menghambat pelaksanaan jaminan perlindungan hukum terhadap risiko kerja perawat dalam pelayanan keperawatan.

A nurse has a big risk in giving nursing care, the necessary protection for nurses. According to the Regulation of the Minister of Health of the Republic of Indonesia Number HK.02.02 / Menkes / 148 / I / 2010 on Permit and Implementation Practice Nurse, one of the rights of nurses is to obtain a guarantee of protection against the risk of work-related duties. Occupational risks nurses according to Mohammad Khoirul consists of the risk of contracting the disease and accidents, the risk of working 24 hours, the risk of stress due to pressure of work, the excess risk of tasks that are not accompanied by overtime pay, the risk of getting medical services is small, the risk of the complaints of the patients, the risk of not can live a normal life because of irregular work. Author formulates the problem: How guarantees legal protection against the risk of nurses working in nursing care in PHC Kahuripan Tasikmalaya? What factors are likely to affect the implementation of legal protection nurse? Based on the opinion of Muhammad Khoirul and the Ministry of Health over the guarantee of legal protection against occupational risks nurses, can be limited by the following parameters:
1. Protection of contracting the disease and work accidents.
2. Protection of job security for 24 hours.
3. Protection against psychological conditions of nurses and pressure of work.
4. Protection of excess overtime guarantees and job duties.
5. Protection of health benefits such as medical services.
6. Protection against the demands of patient complaints.
7. Protection of normal life
One conclusion can be drawn that the general guarantee of legal protection against the risk of nurses working in nursing services is relatively adequate. As for the factors that affect the implementation of legal protection tends to favor and hamper the implementation of legal protection against the risk of nurses working in nursing services.
