Abstrak (Bhs. Indonesia)

Indonesia adalah negara hukum. Pengakuan demikian termaktub dalam Pasal 1 ayat (3) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Sebagai negara hukum, segala aspek kehidupan harus senantiasa berdasarkan atas hukum. Demokrasi mempercayai bahwa pemilihan umum memainkan peranan vital untuk menentukan masa depan bangsa. Sebagaimana transisi demokrasi, pemilihan umum dalam proses konsolidasi demokrasi membutuhkan prakondisi yang spesifik. Pemilihan umum diakui secara global sebuah arena untuk membentuk demokrasi perwakilan serta menggelar pergantian pemerintahan secara berkala. Pemerintahan demokrasi berdasarkan perwakilan, yaitu suatu bentuk pemerintahan dimana warga negara melaksanakan hak yang sama tetapi melalui wakil-wakil yang dipilih mereka dan bertanggungjawab kepada mereka melalui pemilihan-pemilihan yang bebas.
Tindakan khusus sementara atau affirmative action merupakan bentuk kebijakan yang bertujuan untuk memberikan persamaan kesempatan dalam rangka mencapai keadilan antara lain dengan menciptakan aksebilitas, alih bahasa maupun kuota. Dalam konteks politik, affirmative action dilakukan untuk mendorong agar jumlah perempuan di lembaga legislatif lebih representatif.  
Meningkatkan jumlah perempuan dipanggung politik merupakan isu yang tidak pernah selesai dibicarakan dan diperdebatkan dalam dunia hukum dan politik di Indonesia. Jika dilihat pembicaraan dan perdebatan tersebut lebih mengarah pada penguatan hak-hak dasar perempuan sebagai warga negara atau lebih tepatnya hak politik perempuan. Penguatan hak politik perempuan dan keterwakilan perempuan dalam lembaga legislatif dengan kebijakan affirmative action yang dituangkan dalam peraturan perundang-undangan di bidang politik terus disempurnakan. Hal tersebut dilakukan guna mencapai critical mass atau critical minority keterwakilan perempuan sekurang-kurangnya 30% serta guna menjamin kesetaraan dan keadilan gender.

Indonesia is the state of law. This acknowledgment is explained in the Article 1 subsection (3) Constitution Republic of Indonesia in 1945. As the state of law, all the aspects of life must be based on the law. Democracy believes that the election plays the critical role to determine the future of country. As the transition of democracy, the election in the process of democracy consolidation needs the specific precondition. The election is admitted in global as the competition to establish representative democracy and implements the transformation of government periodically. Democracy government  bases on the  representation, it is a form of government where  the  society of country  conducts  similar right  but  through the  elected representative and they responsible for their participants through the independent election. 
	The affirmative action is the form of policy that aims to give the similar chance in order to achieve the justice such as by creating the accessibility, language representation or quota. In the context of politic, affirmative action is conducted to encourage the number of women in the legislative institution to be more representative.   
	Increase the number of women in the politic representation is the issue that never ending to be discussed and debated in the world of law and politic of Indonesia. If looking at the discussion and debating it tends to go to the strengthening of the basic right of women as the citizen or rather the political right of women. The strengthening of the political right of women and their  representation in the legislative institution  with the policy of  affirmative action that is explained in the regulation of ordinance  in the filed of politic keeps being  perfected. It is conducted to achieve the critical mass or critical minority representation of women at least 30% and to guarantee the similarity and justice in gender.
