Kewenangan Pengadaan PNS juga dimiliki oleh Badan Kepegawaian Negara, atau disingkat BKN yang merupakan Lembaga Pemerintah Non KementerianIndonesia yang bertugas melaksanakan tugas pemerintahan di bidang manajemenkepegawaian negara. Kewenangan Badan Kepegawaian Negara dalam penyelenggaraan Pengadaan PNS diatur dalam Peraturan Nomor 58 Tahun 2013 Tentang Badan Kepegawaian Negara dan mengenai pelaksanaannya diatur dalam Peraturan Kepala Badan Kepegawaian Negara Nomor 9 Tahun 2012 Tentang Pedoman Pelaksanaan Pengadaan Calon Pegawai Negeri Sipil.Penelitian ini bertujuan untuk mengetahui kewenangan Kantor Regional I Badan Kepegawaian Negara Yogyakarta dalam penyelenggaraan Pengadaan Calon Pegawai Negeri Sipil.Guna mencapai tujuan tersebut maka penelitian ini dilakukan dengan menggunakan pendekatan yuridis normatif. Data sekunder yang terkumpul kemudian diolah, disajikan, dan dianalisa secara kualitatif dengan penyajian data teks naratif.
Hasil penelitian menyatakan bahwa, Kewenangan BKN tercantum dalam Peraturan Presiden Nomor 58 Tahun 2013 Tentang Badan Kepegawaian Negara dalam Pasal 3 dimana kewenangan tersebut mencakup perencanaan, pengumuman, pelamaran, penyaringan, pengangkatan Calon Pegawai Negeri Sipil (CPNS) sampai dengan pengangkatan CPNS menjadi Pegawai Negeri Sipil (PNS). Kewenangan BKN merupakan kewenangan atribusi, berdasarkan Pasal 1 bahwaBKN berada di bawah dan bertanggung jawab langsung kepada Presiden sesuai peraturan perundang-undangan.Presiden sebagai delegated legislator, yaitu Presiden berdasar pada suatu ketentuan undang-undang dapat mengeluarkan peraturan pemerintah untuk menciptakan wewenang-wewenang pemerintahan kepada badan atau jabatan tata usaha negara tertentu.

AUTHORITY OFFICE STAFFING AGENCY STATE REGIONAL I YOGYAKARTA CANDIDATE IN THE IMPLEMENTATION OF PROCUREMENT OF CIVIL SERVANTS

Procurement of civil authority is also owned by the State Personnel Board, or an abbreviated BKN Indonesian Non-Government Organization in charge of carrying out government duties in the field of personnel management of the country. Authority of the State Personnel Board in the administration of civil procurement in Rule Number 58 Year 2013 About the State Personnel Board and of its implementation in Rule Head of State Personnel Board No. 9 of 2012 on the Guidelines for Procurement of Public Servants. This study aims to determine the authority of the First Regional Office in Yogyakarta State Personnel Board in the implementation of the Procurement of Public Servants. To achieve these objectives, the study was conducted using a normative juridical approach. Secondary data were collected and processed, presented and analyzed qualitatively with the presentation of narrative text data.
The study states that, BKN Authority stated in Presidential Regulation Number 58 Year 2013 About the State Personnel Board in Article 3 where such authority covers the planning, announcements, applying, filtration, removal of the candidate for Civil Servants (CPNS) until the appointment of ID into the Civil Service (PNS). BKN authority is the authority attribution, under Article 1 that BKN under and directly responsible to the President of the appropriate legislation. President as delegated legislator, namely the President, based on a provision of the law may issue regulations to create an authority of government to the agency or office of a particular state administration.
